Thailand Enhances Protection for Air Travelers with New Passenger Rights Regulation

BANGKOK — Thailand is set to significantly strengthen air passenger protections with a new regulation issued by the Civil Aviation Board (CAB), chaired by Deputy Prime Minister and Minister of Transport Suriya Juangroongruangkit.

CAB Regulation No. 101, titled Measures to Protect the Rights of Passengers on Scheduled Domestic and International Flights, will officially take effect on May 20, 2025, aiming to safeguard the rights of travelers impacted by flight delays or cancellations—particularly those who are already at the airport.

Key Provisions for International Flight Delays

The regulation outlines escalating obligations for airlines based on the length of a delay:

  • Delays over 2 hours: Airlines must provide passengers with complimentary food, beverages, or vouchers, as well as free communication tools to stay in contact with others.
  • Delays over 5 hours: Passengers are entitled to:
    • A cash compensation of 1,500 baht, or equivalent alternative compensation (such as vouchers or travel credits) within 14 days;
    • Hotel accommodation and transportation if an overnight stay is necessary;
    • The right to cancel the trip and receive a refund or alternative arrangements.
  • Delays over 10 hours: Passengers must be offered the choice of:
    • Immediate cash compensation:
      • 2,000 baht for flights up to 1,500 km,
      • 3,500 baht for flights between 1,500–3,500 km,
      • 4,500 baht for flights over 3,500 km;
    • Or alternative compensation of equal or greater value (e.g., mileage points, vouchers) within 14 days;
    • Plus accommodation and transport where needed;
    • And full refund or rerouting options for those opting not to continue their journey.

This regulation marks a major milestone for consumer rights in Thai aviation, bringing the country’s standards more in line with international norms and reinforcing Thailand’s commitment to passenger care.

The Ministry of Transport has stated that these protections are part of a broader strategy to build passenger trust and enhance Thailand’s image as a global aviation hub.
