Today (Monday), Thailand’s Supreme Administrative Court overturned the Central Administrative Court’s decision. The Foundation for Consumers’ suit wanted to get rid of a National Broadcasting and Telecommunications Commission resolution that recognized the merger between True Corporation and Total Access Communication (DTAC).
As a result of the decision, the Central Administrative Court must accept the foundation’s lawsuit.
The Supreme Administrative Court said that the foundation’s main goal is to protect the rights of customers. Most of these customers use mobile services from DTAC Trinet Company, which is a part of Total Access Communication Public Company, and the proposed merger will have a direct effect on these customers.
Additionally, the court decided that the Central Administrative Court has the power to accept the foundation’s claim even though it was submitted after the deadline. This is because the proposed merger could make it much harder for consumers to get free and fair competition.
